Tradoshi ("Tradoshi", "we") makes its website and related services (together, the "Service") available to you, subject to compliance with these terms and any other written agreement between us. By using the Service, you agree to be bound by these terms. If you do not agree, stop using the Service. Your sole remedy in case of dissatisfaction is to stop using the Service. These terms take effect as soon as you begin using it. We may amend them at any time; it is your responsibility to review them regularly, and continued use constitutes acceptance of the amended version. Our "Affiliates" means our officers, partners, subsidiaries, providers and partners involved in creating and delivering the Service.
The Service notably provides a trading journal, analysis and statistics of your trades, a discipline score, risk management, AI-powered analysis and recommendations, and an optional voice check-in. You are responsible for providing, at your own expense, the equipment and internet access required. We may modify or discontinue all or part of the Service at any time, without incurring liability. Any new feature is subject to these terms.
Access to certain features requires an account created through our sign-up form. You warrant the accuracy of the information provided and undertake to keep it up to date. The processing of your data is described in our Privacy Policy.
Your use is subject to applicable laws and you are solely responsible for your communications. You agree not to post, transmit or distribute content that:
We assume no responsibility for content submitted by users and may remove, at our sole discretion, any content that violates these terms. You may not attempt to gain unauthorized access to another account, network or server, nor disrupt others' use of the Service. We may terminate your access in case of violation, and cooperate with the competent authorities.
The Service is offered on a subscription basis (Essential, Pro and Premium plans, monthly or annual), paid in advance. A free 7-day trial is offered: a payment card is required, but no charge is made during the trial. At the end of the trial, the subscription continues and is billed automatically, then renewed each period until cancellation. Payments are processed by our payment provider and billed by Scalio-IA. You may cancel at any time from your account; cancellation takes effect at the end of the current period. See also section 22.
If you join the partner program, you earn a commission on subscriptions taken out via your link, according to the tiers indicated. Commissions are paid upon actual collection of payments. Any fraudulent use (self-referral, fake subscriptions) results in exclusion and cancellation of commissions.
The Service may link to third-party sites or content we do not control. We are not responsible for their accuracy, legality or availability. The presence of a link does not imply any endorsement on our part.
All content of the Service (text, data, software, images, graphics, sounds, trademarks, logos) is protected and remains the property of Tradoshi or its suppliers. You may not copy, reproduce, modify, republish, transmit or distribute these elements without our prior written authorization, except for a single copy for personal use. Nothing herein grants you any right to our trademarks or our name.
The information on the Service is provided for information and educational purposes only. Although we strive to be accurate, no information should be considered the sole basis for an actual investment decision. We do not guarantee the accuracy, completeness, usefulness or timeliness of the information, and endorse no opinion or recommendation that may appear in it.
You assume all risks associated with decisions made on the basis of the information on the Service. We never recommend buying or selling any particular instrument. Before any operation, consult your broker or an advisor. We disclaim all responsibility for investment decisions based on the Service.
The voice check-in estimates an emotional state from your voice. It is an indicative aid, in no case a diagnosis or a medical or psychological opinion. This feature is optional and is only activated with your consent.
You retain your rights to the notes and content you create in the Service. By providing them, you grant us a limited license, necessary solely for the operation of the Service (to store them, display them to you, process them). You warrant that you hold the rights to what you submit and undertake not to include information you are not authorized to disclose. You agree to indemnify us against any claim related to your content or your use of the Service.
The Service and its content are provided "as is" and "as available", without warranty of any kind, express or implied. We do not warrant that the Service will meet your needs, or be uninterrupted, timely, secure or error-free, nor that the results obtained will be accurate or reliable. The Service may contain inaccuracies or technical errors. Its use is at your own risk; you are solely responsible for any damage to your equipment or loss of data resulting from it.
In no event shall Tradoshi or its Affiliates be liable for indirect, special, incidental or consequential damages of any kind (loss of use, data or profits), even if advised of their possibility, arising from the use of the Service or any linked site.
You agree to defend, indemnify and hold harmless Tradoshi and its Affiliates against any claim, liability and expense (including attorneys' fees) arising from your use or misuse of the Service.
You are solely responsible for the confidentiality of your password and account, and for all activity that takes place there. Our teams will never ask you for your password. You may not assign or share your account. Notify us immediately of any unauthorized use. We are not responsible for losses resulting from failure to comply with this obligation.
The Service may be accessible worldwide, with no guarantee that it is appropriate or available in every territory. Those who access it from other locations do so on their own initiative and are responsible for compliance with local laws.
We may, at our sole discretion, suspend or terminate your access to all or part of the Service, with or without notice, notably in case of violation of these terms or suspicious activity. Upon termination, your right to use the Service ceases immediately and we may deactivate or delete your account and the associated data.
These terms are governed by the laws applicable at the place of establishment of the entity operating Tradoshi, without regard to conflict-of-law rules. Any dispute relating to the Service falls under the competent jurisdiction of that jurisdiction.
All notices are given by email. Notices to us must be sent to contact@tradoshi.com. We may inform you of changes to the Service via messages displayed in the application.
These terms constitute the entire agreement between us and supersede any prior agreement on the same subject. If a clause is found invalid, it will be interpreted in accordance with applicable law and the remaining clauses will remain fully in effect. Failure to enforce a clause does not constitute a waiver. You may not assign your rights under these terms; we may freely assign ours. You undertake not to resell or reproduce all or part of the Service for commercial purposes.
The 7-day trial is free: if you cancel before it ends, no amount is charged. Once billing has started, all payments are final and non-refundable. It is your responsibility to cancel your subscription before each renewal if you no longer wish to be billed; Tradoshi is not responsible for a renewal due to a forgotten cancellation, and it is up to you to confirm that your cancellation has been taken into account. Cancellation is done from your account.
